At The Movement Studio Pte Ltd (“TMS”), we are committed to protecting the privacy, security, and confidentiality of all personal information entrusted to us. This Privacy Policy (“Policy”) explains how we collect, use, disclose, and safeguard your information when you interact with us through The Movement Studio Website (themovement.studio, the “Website”), The Movement Studio Mobile Application (the “App”), and the TMS Management System powered by Wellyx (together, the “Platforms”), as well as through registration forms and during participation in our classes and activities.

By using our Platforms or services, or by registering yourself or your child with TMS, you consent to the practices described in this Policy.

1. YOUR PRIVACY

We will take reasonable care to ensure that your personal information is accurate, complete, up-to-date and stored in a secure environment, protected from unauthorised access, modification, loss or disclosure.

2. PERSONAL INFORMATION

“Personal Information” means any data that identifies you or your child. This may include:

  • Name, date of birth, gender, and nationality.

  • Contact details (phone number, email, mailing address).

  • Emergency contact details.

  • Health and medical information (e.g., allergies, asthma, medications, medical history) provided for safety reasons.

  • Service and enrolment details (class history, bookings, attendance, student progression).

  • Payment and billing information (including credit card, PayNow, bank transfer details).

  • Device and technical information collected through cookies and analytics (e.g., IP address, operating system, browser type, pages visited, time spent).

We collect personal information directly from you, from your authorised representatives (e.g., parents or guardians), from third parties such as payment processors, and through automated technologies like cookies.

3. CHILDREN’S DATA

For participants under 18 years of age:

  • A parent or legal guardian must complete the registration and provide consent for the collection, use, and disclosure of the child’s personal data.

  • We do not knowingly collect information from minors without parental or guardian consent.

  • Parents/guardians remain responsible for ensuring the accuracy of their child’s information.

4. HOW WE USE YOUR PERSONAL INFORMATION

Collecting Personal Information helps us better understand what you need from us. We may collect personal information either directly from you or your authorised representatives, from third parties or through our Website, mobile and web applications, services application forms and other methods such as surveys.

 

We use your Personal Information to:

  1. verify identity and eligibility to participate.

  2. plan, provision and bill for products and services;

  3. provide access to, personalise your experience on, and improve the functionality of our TMS Website and TMS App;

  4. manage your relationship with customer care related activities and technical assistance through remote access;

  5. notify you with details of products, services, special offers and rewards that we think will be of interest to you;

  6. carry out market and product analysis to improve our products and services and the marketing of our products and services;

  7. gather feedback and statistics to improve our network, servers, Website and App;

  8. improve your user experience through profiling and analysing your preferences;

  9. manage bad debt and prevent fraud or illegal activities;

  10. carry out activities connected with running of our business (such as personnel training, quality control, dispute resolution, and network monitoring) and in connection with the transfer of any part of our business in respect of which you are a customer or potential customer;

  11. investigate any action that may threaten network security or integrity;

  12. complying with any applicable law, regulations, guidelines or rules or to render assistance to law enforcement, governmental and regulatory agencies;

  13. provide complementary products or services, or rewards to you from our business partners; and

  14. other related purposes.

 

The Movement Studio will not use your Personal Information for any purpose not permitted by law or beyond the stated purpose you have consented to. The TMS Website may contain links to other sites. We are not responsible for the privacy practices or the content of such Websites.

5. WHO WE SHARE YOUR INFORMATION WITH

From time to time, we use other third parties to perform obligations related to the provision of our products or services. Those entities may include:

  1. companies related to us;

  2. Wellyx, which provides the integrated booking, account management, and payment processing platform used by TMS.

  3. our business partners, marketing partners and authorised service providers;

  4. credit providers or credit reporting agencies; and

  5. law enforcement, governmental and regulatory agencies.

 

We are required to disclose your Personal Information to the parties described above so that they may carry out their obligations to us, and to you. Our disclosure of your Personal Information may, at times, be subject to their privacy policies. To every extent possible, we require these parties to act consistently with the personal information protections we have put in place.

We do not sell or trade personal data to third parties. All disclosures are limited to purposes consistent with this Policy.

5. HOW YOU CAN ACCESS AND UPDATE YOUR PERSONAL INFORMATION

You can access, correct or update your listed customer details by logging in to your The Movement Studio account on the Website or App.

 

If you require access or a copy of your Personal Information within our possession, please contact us and we will assess your request. In some cases, we may impose a reasonable charge for making copies of Personal Information available to you. If so, we will advise you of the charge prior to making the information available to you.

6. MARKETING & COMMUNICATIONS

  • You may receive service-related communications (class schedules, booking confirmations, policy updates). These are necessary and cannot be unsubscribed from.

  • You may also receive marketing communications about promotions, events, or services. You may opt out of marketing at any time by clicking “unsubscribe” in our emails or contacting us (see Section 13).

7. PHOTOGRAPHY & MEDIA

  • By attending classes, rehearsals, or events, participants consent to TMS capturing photographs or videos that may be used for training, publicity, and promotional purposes, including but not limited to online classes, social media, websites, advertising, and marketing materials.

  • Parents or guardians of participants under 18 years old may notify TMS in writing before the start of a term or program if they do not wish their child to be included.

8. DATA RETENTION

We retain personal data only as long as necessary to fulfil the purposes outlined in this Policy, or as required by law. When data is no longer needed, it will be securely deleted or anonymised.

9. SECURITY MEASURES

We implement reasonable technical and organisational measures to protect personal data, including encryption, access controls, and secure storage systems. However, no method of transmission or storage is completely secure, and TMS cannot guarantee absolute security.

10. DATA BREACH NOTIFICATION

In the event of a data breach that results in, or is likely to result in, significant harm or impact to you, TMS will notify you and the relevant authorities as required under applicable laws.

11. CROSS-BORDER DATA TRANSFERS

The TMS Management System is powered by Wellyx, a third-party provider that enables booking, account management, payments, and communications. Your personal data may therefore be processed and stored on systems operated by Wellyx, which may be hosted outside Singapore.

TMS will take reasonable steps to ensure that such transfers comply with Singapore’s Personal Data Protection Act (PDPA) and that your personal data continues to receive a standard of protection comparable to that under Singapore law.

12. ACCESS, CORRECTION & WITHDRAWAL OF CONSENT

  • You may access or update your account details by logging into the Platforms.

  • To request access to, correction of, or a copy of your personal data, please contact us (see Section 13). A reasonable fee may be charged for providing copies.

Withdrawal of Consent

  • You may request to withdraw your consent to the collection, use, or disclosure of your personal data by contacting us (see Section 13). Your request will take effect within 30 days upon receipt.

  • Please note that the use of your personal data may be essential for us to provide products or services you have subscribed to. Withdrawal of consent may therefore impair our ability to continue providing those services.

  • Withdrawal of consent does not affect our right to continue to collect, use, and disclose personal data where permitted or required under applicable laws.

Marketing Communications

  • If you wish to withdraw consent to receive marketing messages from TMS or its business partners, you may unsubscribe using the link in our communications or contact us directly.

  • Your request will be processed within 30 days. Non-marketing messages (e.g., booking confirmations, service updates, policy changes) will not be affected.

12. FILMING AND PHOTOGRAPHY OF CLASS

The Movement Studio will take images, photos or videos that may be used to promote TMS classes and events in the future. TMS will notify and obtain consent from parents or guardians of children (persons below the age of 14 years old) prior to any photography, audio recording, video recording. By entering the premises and attending the class, you consent to your photography, audio recording, video recording and its release, publication, exhibition or reproduction to be used for TMS’ online classes, promotional material, broadcasting, advertising, inclusion on websites, social media or any other purpose by The Movement Studio, its agents and representatives. 

 

By attending the class, you release The Movement Studio, its employees and any and all

persons involved from any liability in connection with the taking, recording, digitising, publication and use of photographs, computer images, video or sound recordings. 

 

By entering the premises and attending the class, you waive all rights you may have to any claims for payment or royalties in connection with any use, exhibition, streaming, webcasting, televising, or other publication of these materials, regardless of the purpose or sponsoring of such use, exhibiting, broadcasting, webcasting, or other publication and irrespective of whether a fee for admission or sponsorship is charged. 

 

You also waive any right to inspect or approve any photo, video or audio recording taken by The Movement Studio, its employees or any person or entity designated to do so by The Movement Studio.

13. CHANGES TO THIS PRIVACY POLICY

We may amend this Privacy Policy from time to time without prior written notice. Updates to the Privacy Policy will be published on this page, with the date of revision included. We encourage you to review this page periodically.
