TERMS OF SERVICE

1. APPLICATION OF THESE TERMS AND CONDITIONS
With effect from 28 August 2021:
These “Terms and Conditions”, as operated by The Movement Studio Pte Ltd (“TMS”), shall govern your relationship with TMS, including but not limited to, the use of the TMS Website (themovement.studio, the “Website”) and the TMS Mobile Application (the “App”) to manage your account, bookings, communication, purchases and registration with TMS, as well as the use of and attendance at TMS Studio.
By your attendance at TMS and usage of the Website, App, and facilities, you signify your acceptance of the Terms. If you do not agree to this, please refrain from using the Website or App, purchasing a TMS class, booking a TMS class, and/or using or attending a TMS class.
TMS has the rights to amend this information without notice. The Terms may be revised at any time by updating this posting. By using the Website or App, buying TMS Class Packs, booking classes, buying merchandise, your communication with TMS, and your use of and attendance at TMS’ Studio, you agree to be bound by any such revisions. TMS clients are encouraged to check this document periodically to stay informed of current guidelines.
2. CLASS BOOKINGS
You will need to sign up either on the TMS Website or TMS App and make relevant payment before a booking can be made. To safely manage the capacity in our studio, clients will need to book a class in advance via our Website or App to secure a spot. Bookings can also be made through our Live Chat, at our Front Desk in person, or by contacting the studio.
Bookings can be made up to exactly 30 days (720 hours) prior. That means, if you’re looking to book a class on Aug 31, 6pm, bookings will open Aug 01, 6pm. We highly encourage use of the waitlist if you are ready and able to attend on short notice. Otherwise, you are able to “Walk-In” to classes with available space. Bookings are always encouraged to avoid disappointment!
We highly recommend that you plan to be at the studio fifteen (15) minutes before the start of your class, to allow for any travel challenges, and simply to give yourself the time to check-in and to settle in - especially if it is your first visit (back) with us!
3. CLASS CANCELLATION POLICY
You are able to cancel your class booking without any charges or loss of class credits from your Class Pack up until six (6) hours prior to class commencement time for all classes. Should you not cancel class before this time, or simply not show up for the class, one class credit will be deducted from your active Class Pack or single class purchase.
Cancellations can be made through the TMS Website, App, Live Chat or by contacting the studio at +65 8849 6694.
4. LATENESS POLICY AND EARLY DEPARTURE
If you are running late for your booked class, we ask that you call the studio to let us know you are on the way. Once class is in session, you will not be allowed into class and your credits will be forfeited. This is for your safety and the courtesy of the class. The front desk will hold a booking only until the class begins.
If it’s a busy period and the class is waitlisted, our staff will have the right to give your slot to walk-ins that have made it to class on time. This can and will be done at their complete discretion. To avoid disruptions and any compromise to your safety, clients who are late will not be admitted to class. Attendees are strongly discouraged from leaving the studio before the end of class, unless in an emergency. Attendees' re-entry to class when deemed unsafe or disruptive will be at the discretion of the instructor. If an early departure is made by choice, your class will not be returned.
5.CLASSES AND CLASS PACKS
Purchases of classes or Class Packs can be made online on the TMS Website or through the TMS App. We accept contactless payment via Bank Transfers, Internet Banking, ATM Transfers and PayNow. Your Class Pack will initiate on the date of activation. You can view all The Movement Studio classes and class prices on the TMS Website or TMS App.
Purchased classes are only for the use of the individual that purchased the classes. You cannot gift your classes, redeem them for cash, or onsell them outside of TMS. Any classes or Class Packs that have been purchased anywhere other than TMS will not be honored.
Future class prices are subject to change, however, TMS will honor your class or series of classes until the expiration date and no longer.
All Class Packs do expire. The validity of your Class Packs will be clearly stated on your Class Pack purchase receipt. These validities vary based on Class Pack sizes. Promotional Class Packs may also carry different validity periods. We will notify you a month before the expiration of your Class Pack.
If, however, you cannot finish your classes within the allotted validity period, TMS will allow up to one (1) month per extension, per package. These extensions must happen when the package is still active within the validity period.
Should your Class Pack expire, we do allow rollover of expired classes into a newly purchased Class Pack, only if this purchase is made within the month of the expiration date of your expired Class Pack. You cannot rollover class credit from a Single Class purchase. The validity of rolled over class credits will be in line with the stated validity of your newly purchased Class Pack. Please note you cannot rollover a rolled-over class.
Terms and conditions may vary for limited edition promotional packs. Please refer to your purchase screen for specific details relating to special pack promotions.
Should there be special circumstances regarding your ability to complete your package, refer to clause VI.
All Class Pack purchases are final and non-refundable.
6. SPECIAL CIRCUMSTANCES AND RIGHT TO TRANSFER OF PACKAGE
We will grant a one-time transfer at an administration fee of $30.00 per Class Pack. Transfers can only be done before the expiration date of the Class Pack. The validity of the transferred package will not restart, but continue as it is at the time of transfer. Partial transfers are not allowed.
7. RETAIL AND MERCHANDISE
All retail and merchandise sales are non-refundable at TMS. All merchandise, with the exception of sale items (if any), may be exchanged within seven (7) days of the initial purchase date, as long as the product is unused and unsoiled, with all tagging still intact.
TMS will occasionally, at its own discretion, conduct sales on TMS Merchandise and other products. All sales on discounted products are final. Exchanges are not offered on sale products.
8. LOST OR DAMAGED PERSONAL PROPERTY
TMS’ studio is open-concept and provides shelves to house your personal goods when class is in session. TMS also maintains CCTV at all studio common areas. Regardless of care taken to avoid loss, TMS is not liable or responsible for any damage, theft, loss, or destruction of personal property within the TMS Studio.
9. WAIVER AND RELEASE
By signing up for and/or attending classes, events, activities, and other programs and using the premises, facilities and equipment (individually and/or collectively, the "Classes and Facilities") of TMS, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns, that there are certain inherent risks and dangers in partaking activities at TMS.
You voluntarily assume all responsibility for any risks or loss, property damage, or personal injury, including death, that may be sustained, or loss or damage to property owned by me, as a result of participation in this studio. You acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injuries and that TMS and the TMS Team will not be liable for any injury or damage should you choose to participate.
You hereby release, waive, discharge, and covenant not to sue TMS and their employees from any and all liability claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained, or to any property belonging to me while participating in physical activity, or while on or upon the premises where the course is being conducted. You hereby further agree that this waiver of liability and hold harmless agreement shall be constructed in accordance with the laws of Singapore.
If in the subjective opinion of the TMS staff, you and/or others would be at physical risk using TMS' Classes and Facilities, you may be denied access to the Classes and Facilities.
10. QUERIES AND DISPUTE RESOLUTION
At TMS, we do our best to make sure you have a great experience every time. Whenever someone purchases a TMS class pack, we feel indebted to that individual by way of excellent service. We do acknowledge that from time to time, our expectations don’t align. Should this happen, we hope you will give us the opportunity to try to address any challenge you may be facing at TMS.
To do that, please email us at firstname.lastname@example.org with the Subject “Queries and Dispute Resolution” or write to us at The Movement Studio, Sunshine Plaza, 91 Bencoolen St, #05-06, Singapore 189652. Attention: The Movement Studio. Please include: (1) your name, (2) your address, (3) a description of your concerns, and (4) a description of the specific relief you seek.
All queries and dispute resolution will be dealt with promptly, seriously and with sensitivity and remain confidential.
11. LINKS AND THIRD PARTY SITES
TMS has not reviewed all the sites linked to the Website and/or App, and is not responsible for the content or any off-site pages or other linked sites. Although a third-party website and/or app may contain the TMS logo, please understand that it is independent from TMS, and that TMS has no control over the content of that website and/or app. Going to third party or off-site websites from the Website and/or App is at your own risk. These links do not imply endorsement of, sponsorship of, or affiliation with TMS.
12. INTELLECTUAL PROPERTY RIGHTS
The trademarks of TMS are proprietary to TMS and may not be used by you for any reasons other than as expressly permitted by these Terms. All Website and App content, design, text, graphics, and interfaces; the collection, selection, and arrangement thereof; and all software are property of, or duly licensed to, TMS. You have the right to view, electronically copy, and print in hard copy portions of the Website and App for the sole purpose of making class reservations, purchases, or other personal use.
Any other use of materials on the Website and App, including modification, distribution, or reproduction for purposes other than those noted above, without the prior written permission of TMS, is strictly prohibited.
You acknowledge that TMS and/or third-party content providers remain the owners of all Website and App materials, and that you do not acquire any of those ownership rights by downloading, copying, or using any such material in accordance with these Terms. TMS may discontinue or remove the Website or App, or any portion thereof, or discontinue your right to use the Website or App, or any portion thereof, at any time.
13. USE OF THE SITE AND STUDIOS BY MINORS
If you are under the age of 16, you must seek the permission of a parent or guardian before accessing and/or making any class bookings through the various booking platforms. Minors under the age of 16 are encouraged to practice alongside a parent or guardian. We discourage all minors under the age of 16 from attending any adult classes. Refer to Clause (9) for our Waiver and Release terms. The Movement Studio will not be liable for any misuse of the TMS Website or the TMS App.
14. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY
In no event will TMS be liable for any direct, indirect, special, or other consequential damages resulting from your use of the Website, the App, or on any other linked/third-party website, your purchase of TMS classes, your booking of classes, your purchase of merchandise, your communication with TMS, and your use of and attendance at TMS studio, including without limitation, any lost profits, business interruption, loss of programs, or other data on your information handling systems or otherwise, including any claims waived by you previously in this agreement even if TMS expressly advised of the possibility of such damage.
All information, goods, services, products and experiences are provided by TMS on an "as-is" basis only. The entire risk as to the quality and performance of the goods, services, products and experiences remains with you. Should the goods, services, products and/or experiences prove defective after purchase, you assume the entire cost of such defect. TMS provides no representations and warranties, express or implied, including the implied warranties of fitness for a particular purpose, merchantability, and non-infringement.
15. CHOICE OF LAW
The Terms are governed by the laws of Singapore.
