TERMS OF SERVICE

1. APPLICATION OF THESE TERMS AND CONDITIONS

With effect from 14 September 2025:

 

These “Terms and Conditions”, as operated by The Movement Studio Pte Ltd (“TMS”), govern your relationship with TMS, including but not limited to, the use of the TMS Website  (themovement.studio, the “Website”) and the TMS Mobile Application (the “App”), account management, bookings, communications, purchases, and attendance at classes, programs, and activities conducted by TMS.

These Terms apply to all participants, both adults and children.

  • Adults: agree to these Terms directly when registering and participating.

  • Children (under 18 years old): must be registered by a parent or legal guardian, who accepts these Terms on the child’s behalf and remains responsible for their participation.

 

By using the Website, App, purchasing or booking classes, or attending the studio, you agree to be bound by these Terms.

TMS reserves the right to amend these Terms at any time without notice. Updates will be posted on this page, and continued use constitutes acceptance of any revisions.

2. BOOKINGS & ATTENDANCE

  • Classes must be booked in advance via the TMS Website or App.

  • Walk-ins are subject to class slot availability and may be turned away if no prior purchase or booking has been made.

  • All bookings and payments must be completed in advance before class starts.

  • Arrival at least 10 minutes before class is recommended. Late arrivals may not be admitted, and class credits will be forfeited.

  • Instructors will only mark attendance at the start of class and will not process bookings or payments during teaching time.

  • Low Enrolment: TMS reserves the right to cancel or reschedule any class with fewer than three (3) registered participants. In such cases, affected class credits will be refunded or returned to your account.

2A. LATENESS POLICY AND EARLY DEPARTURE

  • If you are running late for your booked class, please call the studio to inform us.

  • Once class has begun, latecomers may not be admitted, and class credits will be forfeited. This is for your safety and the courtesy of the class.

  • If the class is waitlisted, your spot may be released to walk-ins at the staff’s discretion.

  • Participants are strongly discouraged from leaving class before it ends, except in an emergency. Re-entry will be at the instructor’s discretion, and no class credit will be returned for early departure.

3. CANCELLATIONS & NO-SHOWS

  • Cancellations must be made at least 6 hours before class to retain credits.

  • No-shows or late cancellations will result in the loss of one class credit.

  • Repeated no-shows or late cancellations may lead to suspension of booking privileges or a penalty fee.

 4. PAYMENTS & CLASS PACKS

  • Purchases of classes or Class Packs can be made online through the TMS Website or App. Accepted payment methods include Credit Card, PayNow, Bank Transfer, Internet Banking, and ATM Transfer.

  • Your Class Pack validity begins on the date of activation. Current class prices and pack details are published on the TMS Website and App.

  • Future class prices are subject to change. TMS will honour purchased packs until their stated expiry date, but not beyond.

Ownership & Use

  • Purchased classes are strictly for the individual purchaser. They cannot be shared, gifted, transferred, resold, or redeemed for cash.

  • All purchases are final and non-refundable, except where required by law.

Expiry

  • All Class Packs carry an expiry date stated at purchase. Promotional packs may carry different validities. Where possible, TMS will notify you prior to expiry.

Extensions

  • One (1) extension per pack may be granted for up to one (1) month, subject to administrative fees and approval of an appeal with valid reason. Extensions must be applied for while the pack is still active.

Rollover

  • Expired class credits may be rolled into a newly purchased Class Pack only if the new pack is purchased within one (1) month of the previous expiry. Rollover does not apply to single class purchases, and rolled-over credits cannot be rolled over again. The validity of rolled-over credits will follow the validity of the newly purchased Class Pack.

Promotional Packs

  • Terms and conditions may vary for promotional packs. Please refer to your purchase screen for details.

5. RETAIL AND MERCHANDISE

  • All merchandise sales are final.

  • Exchanges permitted within 7 days if unused, unwashed, and with tags intact.

  • Sale or discounted items are non-exchangeable.

6. STUDIO RULES & CONDUCT

  • Clients must treat instructors, staff, and fellow participants with respect.

  • Inappropriate, disruptive, or unsafe behaviour may result in removal without refund.

  • TMS reserves the right to refuse or discontinue service to any participant whose conduct is deemed unsafe, inappropriate, or disruptive.

  • Appropriate attire and safe conduct are required in all classes.

  • Admission of minors to adult classes is subject to TMS’s discretion and may require parental consent or presence.

6A. PERSONAL PROPERTY

  • TMS’ studio is open-concept and provides shelves to store your belongings during class. TMS also maintains CCTV in all studio common areas. Regardless of precautions, TMS is not liable or responsible for any damage, theft, loss, or destruction of personal property within the studio.

7. HEALTH & ILLNESS

  • Participants must not attend class if unwell, have a fever, or have been advised by a healthcare professional to refrain from physical activity.

  • TMS reserves the right to refuse entry if participants display symptoms of illness.

  • Participants with medical conditions or injuries are advised to consult a physician before engaging in TMS activities.

  • In the event of a medical emergency, TMS may take reasonable steps including first aid or arranging medical treatment. Participants/guardians remain responsible for all related cost

8. INSTRUCTOR SUBSTITUTION & SCHEDULE CHANGES

  • TMS reserves the right to change class schedules, substitute instructors, or reschedule classes when necessary. No refunds will be issued for such changes.

9. FORCE MAJEURE

In the event of circumstances beyond TMS’s reasonable control (including pandemics, government restrictions, natural disasters, or other emergencies), TMS may cancel, postpone, or move classes online.

  • No refunds will be provided. Alternative arrangements (e.g., online classes or credit extensions) may be offered at TMS’s discretion.

10. PHOTOGRAPHY & MEDIA

By registering and participating, you consent to TMS taking photos/videos during classes, rehearsals, and events for training, publicity, and promotional purposes.

  • If you do not wish to be included, you must notify TMS in writing before the start of the term or program.

11. DATA PROTECTION & PRIVACY

  • By registering, you consent to TMS collecting, using, and storing your personal information for class management, communication, and administration, in accordance with our Privacy Policy.

12. LIABILITY & WAIVER

  • By signing up for and/or attending classes, events, activities, or other programs, and by using the premises, facilities, and equipment (individually and collectively, the “Classes and Facilities”) of TMS, you acknowledge on behalf of yourself, your heirs, personal representatives, and assigns, that there are inherent risks and dangers in participating in dance, movement, and fitness activities.

  • You voluntarily assume full responsibility for any risks of injury, loss, property damage, or personal injury (including disability or death), that may be sustained, or any damage to property owned by you, arising out of or connected to your participation.

  • You acknowledge that some of these risks cannot be eliminated regardless of the care taken to avoid injury, and that TMS, its directors, employees, contractors, and representatives (collectively, the “TMS Team”), will not be liable for any injury, loss, or damage except where required by law.

  • You hereby release, waive, discharge, and covenant not to sue TMS or any member of the TMS Team from any and all liability, claims, demands, actions, or causes of action arising out of or related to your participation or presence at the studio.

  • If, in the professional judgment of TMS staff, your participation (or that of your child) would place you or others at physical risk, TMS reserves the right to deny or restrict access to Classes and Facilities.

  • This waiver of liability and hold harmless agreement shall be governed by and construed in accordance with the laws of Singapore.

12A. WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY

  • In no event will TMS be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Website, App, classes, merchandise, communications with TMS, or attendance at TMS programs. This includes but is not limited to loss of profits, business interruption, loss of data, or other intangible losses, even if TMS has been advised of the possibility of such damages.

  • All information, goods, services, products, and experiences are provided by TMS on an “as is” basis without warranties of any kind, express or implied.

  • TMS expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

  • The entire risk as to the quality and performance of the services, goods, and experiences remains with you. Should they prove defective, you assume the full cost of repair or replacement.

12B. THIRD-PARTY LINKS

  • The Website and App may contain links to third-party sites. TMS does not review, control, or endorse these sites and is not responsible for their content.

  • Accessing third-party websites or apps is at your own risk. The presence of the TMS name or logo on such sites does not imply endorsement, sponsorship, or affiliation with TMS.

13. INTELLECTUAL PROPERTY RIGHTS

  • The trademarks of TMS are proprietary to TMS and may not be used by you except as expressly permitted under these Terms.

  • All Website and App content, design, text, graphics, interfaces, and the collection, selection, and arrangement thereof, together with all software, are the property of TMS or duly licensed to TMS.

  • You are permitted to view, download, or print portions of the Website and App solely for your personal, non-commercial use in connection with class reservations, purchases, or participation in TMS programs.

  • Any other use — including modification, reproduction, distribution, or display of materials — without TMS’s prior written consent is strictly prohibited.

  • You acknowledge that TMS and/or third-party licensors retain ownership of all rights, title, and interest in the Website, App, and their content. No rights are transferred to you by downloading, copying, or using such materials.

  • TMS may discontinue or remove the Website, App, or any portion thereof, or discontinue your right to use them, at any time.

14. QUERIES & DISPUTE RESOLUTION

  • TMS is committed to handling all queries and concerns fairly, promptly, and with due care.

  • If you have a concern, please contact us at hello@themovement.studio or melissalim@themovement.studio with the subject line “Queries and Dispute Resolution”.

  • Please include: (1) your name, (2) your contact details, (3) a description of your concern, and (4) the relief you seek.

  • All queries will be treated confidentially.

  • If a matter cannot be resolved, it will be governed by and construed in accordance with the laws of Singapore, and subject to the exclusive jurisdiction of the Singapore courts.

15. ELECTRONIC ACCEPTANCE

By registering online or checking acceptance boxes on the Website/App, you agree that electronic acceptance is binding and has the same legal effect as a signed written agreement.

16. SEVERABILITY

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and Registration Agreement, constitute the entire agreement between TMS and participants. No verbal representations or promises are binding.
